Rep. Becca Balint Statement on Ruling on Judicial Powers and Birthright Citizenship

Today, Rep. Becca Balint (VT-AL), member of the House Judiciary Committee, reacts to the Supreme Court decision in the case of Trump v. CASA. The court ruled 6-3 to restrict federal judges from stopping the nationwide enforcement of blatantly unconstitutional laws. Justice Sonia Sotomayor called the majority’s decision “a travesty for the rule of law.” The ruling does not address the constitutionality of birthright citizenship. The Trump Administration continues to evade the question of the obvious violation of our constitution in trying to end birthright citizenship. “Trump seeks unrestrained, unchecked power. By carefully choosing to go after birthright citizenship in this way, his administration has made it easier to continue to violate the constitution. And the court’s conservative majority is conveniently allowing it by limiting the lower courts’ checks on the President, further emboldening Trump to rule like a king. Today, they avoided the question of birthright citizenship to allow Trump to continue his assault on our rights, on immigrants, and the constitution. Let me be clear today: if you’re born in America, you are American. Anything to the contrary is a blatant violation of our constitutional rights. “This is not only another attack on birthright citizenship, it is an attack on our democracy, making it more difficult for people to individuals their rights. The American people need a judiciary that puts the constitution and the rule of law before anything else.” ### |
